BALI

WAIVER, RELEASE OF LIABILITY, TERMS AND CONDITIONS

Effective for all bookings, registrations, purchases, memberships, class packs, events, trainings, private sessions, rejuvenation sessions, and use of facilities operated by PT Sehat Yoga Management and PT PMA Power Yoga.

1. Definitions and Operator Information
These Waiver, Release of Liability, Terms and Conditions (collectively, these “Terms”) apply to all services, activities, and facilities offered at or through The IN Movement, located at:

The IN Movement premises comprise two distinct operating entities:
PT Sehat Yoga Management (“Studio Operator”) — operates The IN Movement yoga studio, wellness and recovery centre, rejuvenation services, sauna, cold plunge, magnesium pool, and all related programming including classes, workshops, trainings, events, and private sessions.
PT PMA Power Yoga (“Property Owner”) — owns the building, all structures, amenities, and surrounding grounds. PT PMA Power Yoga also independently operates the on-site restaurant and food and beverage services.

References to “The IN Movement,” “we,” “us,” or “our” in these Terms refer to PT Sehat Yoga Management unless the context expressly indicates otherwise. References to “you” or “your” refer to the individual booking, purchasing, registering for, attending, or using any service or facility.

By booking, purchasing, registering for, attending, or participating in any class, event, service, session, or activity with The IN Movement, you acknowledge that you have read, understood, and agreed to these Terms in full.

2. Scope of Activities Covered
These Terms apply to participation in, purchase of, or use of any of the following, whether on-site or arranged through The IN Movement:

  • Yoga classes (group and private)
  • Memberships and class packs
  • Workshops, seminars, and special events
  • Teacher trainings and certification programmes
  • Private sessions and one-on-one instruction
  • Rejuvenation and recovery sessions
  • Sauna, cold plunge, and magnesium pool
  • Studio facilities, common areas, and changing rooms
  • Parking areas and surrounding grounds
  • Restaurant services and dining (operated by PT PMA Power Yoga)
  • Restaurant discounts and membership benefits
  • Partner offers and third-party promotions
  • Any related services, amenities, or experiences offered at the premises

3. Assumption of Risk

You understand and acknowledge that yoga, movement practices, wellness activities, trainings, rejuvenation sessions, and use of facilities involve inherent risks. These risks may include, but are not limited to:

  • Slips, falls, and collisions
  • Muscle strains, sprains, fractures, and soft tissue injuries
  • Aggravation of pre-existing conditions
  • Heat-related discomfort, illness, or heat exhaustion
  • Dizziness, fainting, dehydration, or shortness of breath
  • Risks associated with sauna use, cold plunge immersion, and magnesium pool exposure, including cardiovascular stress, thermal shock, and allergic or skin reactions
  • Risks arising from physical exertion, temperature exposure, wet or uneven surfaces, and group participation
  • Injuries resulting from equipment use or malfunction
  • Exposure to tropical weather conditions, insects, and natural hazards

You understand that classes and sessions at The IN Movement take place in a naturally warm tropical Bali climate. You accept full responsibility for staying hydrated, pacing yourself appropriately, and resting, pausing, or leaving an activity whenever you feel it is necessary.

Participation is voluntary and entirely at your own risk.

4. Health Declaration and Personal Responsibility
By participating in any activity at The IN Movement, you confirm that:

  • You are in good physical and mental health and believe yourself fit to participate
  • You have consulted a qualified medical professional if you have any concerns about your ability to participate in physical activity
  • You will inform the teacher, facilitator, or staff of any injury, medical condition, pregnancy, allergy, limitation, or concern that may affect your participation, prior to commencing any activity
  • You will act responsibly and within your own limits at all times
  • You will immediately stop or modify your participation if you experience pain, dizziness, discomfort, distress, or any other warning sign
  • You will not participate in any activity whilst under the influence of alcohol, drugs, or any substance that may impair your ability to safely participate

The IN Movement, its teachers, facilitators, staff, contractors, and representatives are not medical professionals (unless separately qualified and acting in that capacity) and are not responsible for monitoring your individual capacity. You are solely responsible for determining whether participation is appropriate for you.

5. Infectious Illness and Health Restrictions
You must not use any facility or participate in any class, session, or activity at The IN Movement whilst suffering from any infectious or contagious illness, disease, or condition — including but not limited to open wounds, skin infections, respiratory illness, or any condition that may pose a risk to the health, safety, or comfort of other participants or staff.

The IN Movement reserves the right to deny entry to any person who, in its reasonable opinion, presents a health risk to others.

6. Hands-On Support and Physical Adjustments
Hands-on support or physical adjustments may be offered at the discretion of the facilitator and will be managed on a class-by-class, workshop-by-workshop, or event-by-event basis. You remain responsible for communicating your preferences and boundaries at all times.
If you do not wish to receive hands-on adjustments, you may inform the facilitator verbally before the session begins or use any opt-out mechanism made available by the studio.

7. Release and Waiver of Liability
To the fullest extent permitted by applicable law, you hereby waive, release, and discharge PT Sehat Yoga Management, PT PMA Power Yoga, The IN Movement, and all of their respective owners, directors, shareholders, teachers, facilitators, staff, contractors, employees, agents, affiliates, partners, landlords, successors, and representatives (collectively, the “Released Parties”) from any and all claims, liabilities, demands, actions, damages, losses, costs, or expenses (including legal fees) arising out of or connected with:

  • Your participation in any class, training, event, session, or facility use
  • Your use of the sauna, cold plunge, magnesium pool, or any wellness amenity
  • Your use of the restaurant, common areas, parking, or any part of the premises
  • Any injury, illness, loss, damage, or death, howsoever caused
  • Any advice, instruction, demonstration, or assistance provided
  • The condition, maintenance, or use of the premises, equipment, parking area, or related facilities
  • Any act or omission of another participant, visitor, or third party

This waiver applies whether the claim arises in contract, tort (including negligence), strict liability, or otherwise, except where liability cannot lawfully be excluded under the laws of the Republic of Indonesia.

8. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your breach of any provision of these Terms
  • Your negligent, reckless, or intentional acts or omissions
  • Any injury or damage caused by you to another person or their property while on the premises
  • Any misrepresentation regarding your health, fitness, or ability to participate

9. Emergency Medical Consent
If you become ill, injured, or otherwise require medical attention while participating in activities connected with The IN Movement, you authorise The IN Movement staff or representatives to seek emergency assistance or medical treatment on your behalf if deemed necessary.

You understand and agree that:

  • Any medical or emergency response costs are entirely at your own expense
  • The IN Movement does not assume responsibility for the outcome of any medical treatment or emergency response
  • The IN Movement is not obligated to provide first aid or medical care on-site
  • You are strongly encouraged to maintain your own adequate travel and health insurance at all times

10. Personal Belongings, Parking, and Property
You are solely responsible for your personal belongings at all times. The IN Movement does not provide lockers and accepts no responsibility for the loss, theft, or damage of:

  • Personal items, valuables, jewellery, or cash
  • Clothing, towels, yoga mats, or equipment
  • Phones, laptops, cameras, bags, or other electronic devices
  • Bicycles, motorbikes, cars, or other vehicles
  • Any property left in parking areas, changing rooms, studios, or anywhere on the premises

All vehicles are parked at the owner’s sole risk. The IN Movement and PT PMA Power Yoga are not liable for any loss, damage, or theft of vehicles or their contents.

11. Studio Conduct, Etiquette, and Right to Refuse

11.1 Code of Conduct
All participants, visitors, and guests are expected to conduct themselves with respect, mindfulness, and consideration for others. In particular:

  • Silence mobile phones and refrain from using electronic devices in studio spaces during sessions
  • Photography, video recording, and audio recording are strictly prohibited in all studio and practice spaces unless expressly authorised by The IN Movement
  • Maintain personal hygiene and arrive clean; refrain from wearing heavy cologne or perfume
  • Respect the teacher’s instructions and the practice space of those around you
  • Clean up your space after each session and return all props and equipment to their designated areas
  • If you must leave a session early, do so quietly and respectfully, avoiding departure during Savasana or closing meditation wherever possible
  • Observe the dress code: modest, appropriate activewear that respects the local Balinese Hindu culture
  • Do not promote, advertise, or sell personal services, products, or sessions to other participants on the premises without the prior written consent of The IN Movement

11.2 Right to Refuse
The IN Movement reserves the right to refuse entry, participation, service, or continued attendance to any person whose behaviour is, in its reasonable opinion:

  • Unsafe, disruptive, or inappropriate
  • Intoxicated or under the influence of substances
  • Abusive, threatening, or harassing towards staff, teachers, or other participants
  • Otherwise inconsistent with the wellbeing and character of the studio environment

No refund will be given where entry or participation is refused on grounds of conduct.

12. Booking, Cancellation, No-Shows, and Late Arrival

12.1 Cancellations
Bookings may be cancelled without penalty up to 1 hour before the scheduled class start time.

12.2 No-Shows
If you fail to attend a booked class, session, or applicable service without cancelling in time, it will be treated as attended and the applicable class credit, session, or booking will be forfeited.

12.3 Late Arrival
For the safety and flow of the class, The IN Movement reserves the right to deny entry to anyone arriving more than 10 minutes after the scheduled start time for yoga or movement classes, or if arriving more than 5 minutes after the start of meditation classes.

If entry is denied due to lateness:

  • The booking will be considered used
  • The applicable class credit or session will be forfeited
  • No refund, transfer, or replacement class will be given

13. Membership Terms

13.1 Founding Memberships
Founding memberships are limited offers and may be modified, closed, or discontinued at the sole discretion of The IN Movement at any time.

13.2 Activation
Memberships begin on first use, not on the date of purchase, unless otherwise stated.

13.3 Non-Transferable
Memberships are personal to the purchaser and are non-transferable. A member may not loan, assign, or permit their membership to be used by any other person.

13.4 Auto-Renewal
Unless cancelled in accordance with this section, all memberships will automatically renew at the end of each membership term for a successive term of the same duration, at the same price as the original purchase.

Renewal payments will be charged automatically to the same payment method on file. It is your responsibility to ensure that your payment details are current and valid. If a renewal payment fails, The IN Movement reserves the right to suspend your membership until payment is successfully processed.

Cancellation of Auto-Renewal: You may cancel auto-renewal at any time by using the cancellation function within your membership account. To prevent the next renewal charge, cancellation must be completed by 23:59 (Bali local time, WITA/UTC+8) on the day immediately preceding your renewal date. Cancellations made after this deadline will not take effect until the following renewal cycle.
No partial or pro-rata refunds will be issued for the remaining period of a current membership term following cancellation.

By purchasing a membership, you expressly acknowledge and agree to these auto-renewal terms and authorise The IN Movement to charge your payment method on file for each renewal period until you cancel.

13.5 Pause Policy
Membership pauses may be granted only for travel, illness, or injury and are limited as follows:

  • 1-month membership: may be paused up to two (2) times
  • 3-month membership: may be paused one (1) time

All pause requests must be submitted in writing and are subject to The IN Movement’s approval and operational policies. Pauses do not extend the membership term unless expressly confirmed in writing.

13.6 Included Access Does Not Carry Over
Where a membership includes a fixed number of monthly classes or sessions, any unused allocation does not carry over into the following month.

13.7 Guest Passes
Where included in a membership, guest passes are:

  • Limited to one (1) guest pass per month
  • Not cumulative across months
  • Valid only for regular studio scheduling
  • Not valid for special events, workshops, or offerings outside normal studio scheduling
  • Subject to availability and all studio rules

13.8 Discounts and Benefits
Where included in a membership, discounts and benefits may include:

  • Restaurant discount (applicable at the on-site restaurant operated by PT PMA Power Yoga)
  • Discount on additional rejuvenation sessions
  • Discount on additional classes or class packs

These benefits are personal to the member, non-transferable, subject to availability, and may be changed, suspended, or withdrawn at management’s discretion at any time.

14. Regular Pricing and Class Pack Terms

14.1 Drop-In
Regular Price: IDR 165,000
KITAS / Indonesian Resident: IDR 110,000

14.2 Class Packs (“Commit In”)
5 Class Pack: IDR 700,000 — valid for 14 days
10 Class Pack: IDR 1,350,000 — valid for 30 days
20 Class Pack: IDR 2,200,000 — valid for 60 days

14.3 Class Pack Conditions
Class packs:

  • Begin on the date of purchase unless otherwise stated by The IN Movement
  • Are personal to the purchaser and non-transferable
  • Are not shareable with friends, family, or any other person
  • Expire automatically at the end of the stated validity period
  • Are not refundable in whole or in part
  • Will not be extended except where required by law or expressly approved by management in writing

15. Refunds, Transfers, and Final Sale Policy

15.1 General Policy
All sales are final.
This includes, without limitation: memberships, drop-in classes, class packs, workshops, events, trainings, private sessions, rejuvenation sessions, gift cards, retail purchases, and any other products or services.

No refunds will be given for change of mind, scheduling conflicts, missed classes, partial use, non-use, early departure, travel changes, or personal circumstances.

15.2 Room and Space Rental
For room or space rental, no refund is available. In certain cases, a booking may be transferable at the sole discretion of The IN Movement management.

15.3 Studio and Schedule Changes
The IN Movement reserves the right to change teachers, facilitators, schedules, class formats, operating hours, capacity limits, pricing, or programming at any time without refund obligation.

16. Workshops, Events, Trainings, and Special Offerings
Additional or specific terms may apply to workshops, trainings, teacher training programmes, retreats, private bookings, special events, partner offerings, or limited-capacity experiences. Where specific terms are published for a particular offering, those terms apply in addition to these Terms.

Unless stated otherwise in writing, all cancellation, refund, and conduct policies in these Terms apply equally to workshops, events, and special offerings.

17. Facility-Specific Rules: Sauna, Cold Plunge, and Magnesium Pool
Use of the sauna, cold plunge, and magnesium pool is subject to the following additional conditions:

  • All users must read and follow any posted safety instructions and signage before use
  • Use is at your own risk and subject to the assumption of risk and waiver provisions in these Terms
  • Persons with cardiovascular conditions, high or low blood pressure, epilepsy, pregnancy, or any medical condition affected by extreme temperatures must consult a medical professional before use and must disclose their condition to staff
  • Minors are not permitted to use the sauna, cold plunge, or magnesium pool unless accompanied by a parent or legal guardian and expressly permitted by staff
  • Maximum session durations and temperature guidelines posted on-site must be observed
  • No glass containers, food, or beverages (other than water) are permitted in these areas
  • The IN Movement reserves the right to restrict or deny access to these facilities at any time for maintenance, safety, or operational reasons

18. Restaurant and Food and Beverage Services
The on-site restaurant is independently operated by PT PMA Power Yoga. While The IN Movement may facilitate restaurant discounts or benefits for its members, the restaurant operates under its own management, policies, and terms.

The IN Movement (PT Sehat Yoga Management) is not responsible for the quality, safety, service, or content of food, beverages, or any other product or service provided by the restaurant. Any claims, complaints, or disputes relating to restaurant services should be directed to PT PMA Power Yoga.

Any food allergies, intolerances, or dietary requirements must be communicated directly to restaurant staff.

19. Minors
Participants under the age of 18 years must have a parent or legal guardian agree to these Terms on their behalf before participating in any activity.

The minimum age for participation is 12 years old, and minors must be accompanied by a responsible adult at all times.
The IN Movement reserves the right to restrict minors from certain class types, facilities (including sauna, cold plunge, and magnesium pool), experiences, or events at its sole discretion.

20. Photography, Video, and Marketing Consent
By entering the premises or participating in any class, event, or activity at The IN Movement, you acknowledge and agree that photographs, videos, or other recordings may occasionally be taken by The IN Movement or its authorised representatives for promotional, marketing, educational, or archival purposes.

You grant The IN Movement and its affiliates a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify, publish, and distribute such content in print, digital, social media, website, and promotional materials without compensation.

If you do not wish to be photographed or recorded, you must notify The IN Movement staff in writing or verbally prior to the session. The IN Movement will make reasonable efforts to honour such requests where practicable, but cannot guarantee exclusion in all group or public settings.

You must not photograph, record, or film other participants, staff, or teachers without their express consent.

21. Intellectual Property
All content, materials, branding, logos, class names, programming, course materials, training manuals, and other intellectual property associated with The IN Movement are the property of PT PMA Power Yoga or its licensors and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any such materials without the prior written consent of The IN Movement.

22. Privacy and Personal Data

22.1 Data Collection and Use
The IN Movement may collect and use your personal information for legitimate business and operational purposes, including:

  • Bookings, registrations, and membership management
  • Customer support and service communications
  • Payment processing and invoicing
  • Attendance tracking and capacity management
  • Safety, operational, and emergency communications
  • Marketing, promotions, and newsletters (where you have consented or where permitted by law)
  • Internal analytics, research, and service improvement

22.2 Data Sharing
The IN Movement does not sell, trade, or rent your personal information to third parties. However, we may share information with trusted third-party service providers who assist us in operating our business (such as payment processors and booking platforms), provided they agree to keep your information confidential.

Your data may be shared between PT Sehat Yoga Management and PT PMA Power Yoga where necessary for the administration of membership benefits, restaurant discounts, or operational coordination.

22.3 Cookies and Website
If The IN Movement operates a website, it may use cookies to enhance user experience. You can manage cookie preferences through your browser settings, though disabling cookies may affect certain functionality.

22.4 Data Retention and Consent
By engaging with The IN Movement, you consent to the collection and use of your information for the purposes outlined above. The IN Movement will take reasonable steps to handle personal data responsibly in accordance with applicable Indonesian law. You may request access to, correction of, or deletion of your personal data by contacting team@theinmovement.com.

23. Electronic Communications and Consent
By providing your email address, phone number, or other contact details to The IN Movement, you consent to receiving communications from us via email, SMS, WhatsApp, or other electronic channels for the purposes of booking confirmations, schedule updates, membership information, operational notices, and promotional communications.

You may opt out of promotional communications at any time by following the unsubscribe instructions provided in the communication or by contacting team@theinmovement.com. Opting out of promotional communications does not affect transactional or operational messages.

24. Partner Offers and Third-Party Services
Discounts, partner offers, or third-party services promoted through The IN Movement are subject to the terms, availability, and policies of the relevant third party. The IN Movement is not responsible for the acts, omissions, products, services, quality, or representations of any third-party partner.

25. Force Majeure
Neither The IN Movement nor you shall be liable for any delay or failure in performance resulting from circumstances beyond reasonable control, including but not limited to: acts of God, natural disasters, fire, flood, earthquake, volcanic activity, pandemic, epidemic, government orders or restrictions, war, civil unrest, terrorism, labour disputes, power failure, or interruption of telecommunications or internet services.
In the event of a force majeure occurrence, The IN Movement will make reasonable efforts to resume normal operations as soon as practicable. No refund obligation arises from a force majeure event unless otherwise required by applicable law.

26. Limitation of Liability
To the maximum extent permitted by applicable law:

  • The IN Movement’s total aggregate liability to you for any and all claims arising out of or in connection with these Terms or your use of our services and facilities shall not exceed the total amount paid by you to The IN Movement in the six (6) months immediately preceding the event giving rise to the claim
  • In no event shall The IN Movement be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of enjoyment, or loss of opportunity, regardless of the cause of action or theory of liability

27. Insurance
The IN Movement strongly recommends that all participants maintain adequate personal health, travel, and accident insurance for the duration of their engagement with The IN Movement. The IN Movement does not provide personal insurance coverage for participants.

28. Changes to Terms
The IN Movement may update, amend, or replace these Terms at any time. The current version published on The IN Movement’s website or otherwise made available at reception or via email will apply from the date of publication.

Continued attendance, participation, or purchase after any update constitutes your acceptance of the revised Terms. Material changes will be communicated via email or posted notice where reasonably practicable.

29. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

30. Entire Agreement
These Terms, together with any supplementary terms published for specific offerings, constitute the entire agreement between you and The IN Movement in relation to the subject matter hereof and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.

31. No Waiver
The failure of The IN Movement to enforce any right or provision of these Terms at any time shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by The IN Movement.

32. Governing Law and Dispute Resolution
These Terms are governed by and shall be construed in accordance with the laws of the Republic of Indonesia.

In the event of any dispute arising out of or in connection with these Terms, the parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, the dispute shall be submitted to the jurisdiction of the competent courts located in Gianyar, Bali, Indonesia, unless otherwise required by applicable law.

33. Acknowledgment and Agreement
By booking, purchasing, registering, attending, participating in, or using any service or facility of The IN Movement, you acknowledge and confirm that:

  • You have read and understood these Terms in their entirety
  • You voluntarily agree to be bound by these Terms
  • You understand that you are assuming certain risks and giving up certain legal rights, including the right to bring certain claims against the Released Parties, to the fullest extent permitted by law
  • You are of legal age to enter into this agreement, or a parent or legal guardian has agreed to these Terms on your behalf
  • You agree to receive emails from The IN Movement.

1. Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of The IN Movement™ digital platform, including the website located at https://theinmovement.com and any associated subdomains (the “Website”).

The Website and all digital services made available through it are owned and operated by Canadian Global Consultants (“Company,” “we,” “us,” or “our”).

By accessing or using the Website, purchasing digital products, or enrolling in any online programs, you (“Client,” “you,” or “your”) agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree, you must not access or use the Website.

2. Brand & Entity Structure

The IN Movement™ is a shared brand used by multiple independent legal entities.
Canadian Global Consultants owns, manages, and operates all digital assets, online programs, educational materials, and intellectual property made available through the Website.
PT Power Yoga Bali independently owns and operates physical studio locations and conducts in-person classes, trainings, retreats, and events under The IN Movement™ brand.

Each entity operates independently and is responsible only for the products and services it directly provides.

3. Website Role in In-Person Trainings

The Website may display, promote, or advertise in-person trainings, events, or programs operated by PT Power Yoga Bali.

However:
– The Website does not host, manage, administer, or operate in-person trainings
– The Website does not process registration, payments, refunds, or contracts for in-person trainings
– When you choose to register for an in-person training, you will be redirected to a separate registration and payment platform operated by PT Power Yoga Bali
– Any agreement, payment, liability, refund policy, or dispute related to in-person trainings exists solely between you and PT Power Yoga Bali

Canadian Global Consultants is not responsible for in-person training operations, facilities, instruction, scheduling, or outcomes unless explicitly stated in writing.

4. Educational Nature of Digital Services

All digital content and online programs offered through the Website are provided for educational purposes only.

The Company does not provide medical, therapeutic, psychological, legal, financial, or professional advice. Participation does not establish a practitioner–client, teacher–student, therapist–patient, or fiduciary relationship.

You are solely responsible for your own decisions, actions, health, and results.

5. No Guarantees
The Company makes no guarantees regarding outcomes, physical results, professional success, certification outcomes, income, or business performance.

Results vary and depend on many factors beyond the Company’s control.

6. Payments for Digital Products

You agree to pay all fees associated with digital products or online programs purchased through the Website.

If you enroll in a payment plan, you authorize the Company to charge your selected payment method according to the agreed schedule. Failure to complete payment obligations may result in suspension or termination of access.

7. Refund Policy (Digital Products)

Unless otherwise stated in writing, all digital sales are final.

8. Intellectual Property & License

All digital content available through the Website—including manuals, videos, audio recordings, frameworks, methodologies, text, graphics, and course materials—is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, single-user license for personal educational use only.

You may not reproduce, distribute, sublicense, resell, teach, publish, or create derivative works without prior written consent from Canadian Global Consultants.

All intellectual property remains the exclusive property of Canadian Global Consultants unless otherwise stated.

9. Confidentiality

The Company reserves the right to suspend or terminate access without refund for violations.
